Business Boosted Affiliate Program Terms & Conditions
Effective Date: 2/7/2026
These Affiliate Program Terms & Conditions (“Terms”) govern participation in the Business Boosted Affiliate Program (“Program”). By applying to, enrolling in, or participating in the Program, you (“Affiliate,” “you,” “your”) agree to these Terms. “Business Boosted,” “we,” “us,” and “our” refer to Business Boosted and its owners/operators.
1) Program Overview
The Program allows approved Affiliates to promote Business Boosted products and services using a unique referral link or other tracking method provided by Business Boosted. Affiliates may earn commissions on qualifying purchases made by referred customers (“Referred Customers”), subject to these Terms.
2) Eligibility and Enrollment
- Participation is subject to approval at Business Boosted’s sole discretion.
- You must provide accurate account, payment, and tax information.
- We may reject or terminate any application or account at any time.
3) Commission Structure
- Residual Commission: Affiliates earn 20% residual commission on eligible recurring service fees paid by Referred Customers, each month the Referred Customer remains active and in good standing.
- Commission applies only to qualifying services and plans identified as eligible by Business Boosted.
4) When Commissions Are Earned
A commission is earned only when all of the following are true:
- The Referred Customer is properly tracked to the Affiliate (via link/code/process).
- The Referred Customer’s payment is successfully processed and cleared (not pending).
- The Referred Customer remains in good standing (not in dispute, chargeback, or delinquent status).
5) Payout Timing and Payment Clearance
- Payout Trigger: Affiliates are paid once payment is cleared for the applicable billing cycle.
- “Cleared” means funds are settled and non-reversible through normal processing (e.g., not pending, not failed, not under review).
- We reserve the right to delay payout when fraud checks, risk review, subscription verification, or payment settlement requires additional time.
6) Payout Methods and Minimums
- Payout method: [ACH / PayPal / Check / Other]
- Minimum payout threshold: $[Insert Minimum]
- If the threshold is not met, commissions roll over to the next payout cycle.
7) Chargebacks, Refunds, and Reversals
- If a Referred Customer payment is refunded, reversed, disputed, or charged back, any related commission is not payable or will be reversed/withheld.
- If a chargeback occurs after a commission has been paid, Business Boosted may deduct the amount from future commissions or invoice the Affiliate.
8) Qualifying Customers and Self-Referrals
- Commissions apply only to new, paying Referred Customers that are not already in our system, unless otherwise approved in writing.
- Self-referrals are prohibited (you may not earn commissions on your own purchases).
- Business Boosted may disqualify referrals that appear to be duplicate, fraudulent, incentivized, or abusive.
9) Tracking, Attribution, and Disputes
- Tracking is primarily link/cookie-based and/or code-based. Attribution depends on our system records.
- You are responsible for ensuring your link/code is used correctly.
- Any commission disputes must be submitted in writing within 30 days of the disputed event. Our determination is final.
10) Promotional Rules (Marketing Compliance)
Affiliates must comply with all applicable laws and advertising standards, including FTC Endorsement Guidelines (clear disclosures such as “I may earn a commission…”) and anti-spam laws (CAN-SPAM, TCPA), as well as platform rules (Meta/Google/LinkedIn, etc.).
You may not:
- Make false or misleading claims (including guaranteed rankings, guaranteed revenue, or “instant results”).
- Use “Business Boosted” or confusing variations in domain names, social handles, or ad accounts without written approval.
- Bid on our brand keywords in paid search (e.g., “Business Boosted,” “BusinessBoosted.com”), unless explicitly authorized in writing.
- Use spam, bots, fake leads, or incentivized signups without approval.
- Misrepresent your relationship to Business Boosted (e.g., claiming you are an employee).
11) Use of Business Boosted Brand Assets
- We may provide logos, product names, and approved copy (“Brand Assets”).
- You may use Brand Assets only while in good standing and only as provided (no edits that alter meaning or brand integrity).
- All goodwill associated with Brand Assets belongs exclusively to Business Boosted.
12) Confidentiality
Any non-public information shared with you (pricing, margins, product roadmap, internal processes, client information, etc.) is confidential. You agree not to disclose or misuse it during or after participation.
13) Relationship of the Parties
You are an independent contractor. Nothing creates an employment, partnership, joint venture, or agency relationship. You may not bind Business Boosted to obligations.
14) Taxes
You are responsible for all taxes associated with commissions received. We may require tax forms (e.g., W-9) before issuing payouts.
15) Termination
- Either party may terminate participation at any time, with or without cause, by written notice.
- Upon termination, you must stop using Brand Assets and referral materials immediately.
- Valid commissions earned prior to termination will be paid only if the underlying customer payments clear and are not subject to disputes/chargebacks.
- Business Boosted may withhold commissions if we reasonably suspect fraud, abuse, or violations of these Terms.
16) Program Changes
Business Boosted may update commissions, eligibility, payout policies, and these Terms at any time. Changes take effect when posted or communicated. Continued participation means you accept the updated Terms.
17) Limitation of Liability
To the fullest extent permitted by law, Business Boosted will not be liable for indirect, incidental, special, or consequential damages, or loss of revenue/profit arising from the Program. Our total liability will not exceed commissions paid to you in the prior 3 months.
18) Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflicts of law principles. Venue for disputes will be in Butler Country, Ohio, unless required otherwise by law.
